PLEASE READ THESE TERMS CAREFULLY.

These Terms of Service ("Terms") constitute a legally binding agreement between Longevity Lounge Inc. ("Company", "we", "us", or "our") and you ("User", "Member", or "Guest"). By creating an account, booking a session, purchasing a membership, or entering our facilities located at 5-2175 Richmond Street, London, ON, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access our services.

1. Health & Medical Disclaimer

IMPORTANT: READ BEFORE USE. 

Our services, including but not limited to Sauna, Cold Plunge (Ice Bath), Red Light Therapy, and Compression Therapy, involve significant physiological changes and physical risks.

1. Not Medical Advice: The services provided are for wellness, relaxation, and recovery purposes only. They are not intended to diagnose, treat, cure, or prevent any disease.
2. Consult a Physician: You explicitly acknowledge that you have consulted with a physician prior to using our facilities, particularly if you have any pre-existing medical conditions.
3. Contraindications: You must NOT use our facilities if you suffer from:
   
   • Uncontrolled high blood pressure or heart disease.
   • History of cardiac arrest or stroke.
   • Epilepsy or seizures.
   • Fever, open wounds, or infectious skin conditions.
   • Pregnancy (unless you have specific written clearance from your doctor).
   • Influence of alcohol, narcotics, or tranquilizers.

We reserve the right to deny entry to anyone we believe may be at risk.

2. Release of Liability & Assumption of Risk

By entering Longevity Lounge, you voluntarily assume all risks associated with the use of the facilities.

1. Assumption of Risk: You acknowledge that the use of extreme heat (sauna) and extreme cold (cold plunge) carries inherent risks, including but not limited to: fainting, dizziness, lightheadedness, overheating (hyperthermia), hypothermia, slips and falls on wet surfaces, and skin irritation.
2. Waiver & Release: To the maximum extent permitted by Ontario law, you hereby release, waive, and discharge Longevity Lounge Inc., its officers, directors, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by you while using our facilities.‍
3. Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your negligence while on the premises.

3. Age & Eligibility

• 18+ Policy: You must be at least 18 years of age to use our facilities independently.
• Minors (15-17): Guests aged 15 to 17 are permitted ONLY if accompanied by a parent or legal guardian at all times. The guardian must sign the waiver on behalf of the minor and assumes full responsibility for their safety.‍
• Under 15: For safety reasons, children under 15 are not permitted on the premises.

4. Bookings, Cancellations & Late Policy

All bookings are managed through our third-party partner, WellnessLiving.

1. Payment: Payment is required at the time of booking. We accept major credit cards via Nuvei. We do not store full credit card numbers locally.
2. 24-Hour Cancellation Policy:
   
   • Early Cancel: You may cancel or reschedule up to 24 hours before your session start time for a full refund or credit.
   • Late Cancel / No Show: Cancellations made within the 24-hour window are non-refundable. If you hold a membership, a "Late Cancel Fee" may be charged to your account, or you may forfeit the session credit.
3. Late Arrival: Please arrive at least 10 minutes prior to your session. Late arrivals may be denied entry to ensure the smooth operation of sessions and the relaxation of other guests. No refunds will be given for late arrivals.

5. Memberships & Billing

1. Recurring Billing: By purchasing a membership, you authorize us to charge your credit card on a recurring monthly basis until you cancel.
2. Price Changes: We reserve the right to change membership rates with 30 days' notice via email.
3. Cancellation of Membership: You may cancel your membership by emailing info@longevitylounge.ca. Notice must be received at least 7 days prior to your next billing date. No prorated refunds are issued for partial months.
4. Suspension: We reserve the right to suspend or terminate your membership for failure to pay fees or for violation of our House Rules.

6. House Rules & Code of Conduct

To maintain a safe, sanitary, and respectful environment, all guests must adhere to the following rules:

• Hygiene: You must take a cleansing shower before entering the sauna or cold plunge.
• Attire: Appropriate swimwear or athletic wear must be worn at all times. Nudity is strictly prohibited in public areas.
• Substances: We have a zero-tolerance policy for drugs, alcohol, and smoking (including vapes) on the premises. Guests appearing intoxicated will be denied entry without refund.
• Glassware: No glass bottles or containers are permitted in the wellness zones.
• Respect: Harassment, aggressive behavior, or inappropriate conduct toward staff or other guests will result in immediate ejection and banning from the facility.
• Personal Property: We are not responsible for lost or stolen items. Please use provided lockers for your valuables.

7. Media & Intellectual Property

1. Our IP: All content on the Longevity Lounge website and in-studio branding is the property of Longevity Lounge Inc.
2. Photography: For the privacy of all guests, photography and videography are strictly prohibited in the sauna, change rooms, and shower areas. Limited photography is permitted in common areas provided no other guests are captured without consent.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

1. Mediation: In the event of a dispute, the parties agree to attempt to resolve the matter informally or through mediation.
2. Binding Arbitration: If mediation is unsuccessful, the dispute shall be definitively resolved by binding arbitration pursuant to the Arbitration Act, 1991 (Ontario), rather than in court. The arbitration shall take place in London, Ontario. You hereby waive any right to a jury trial or to participate in a class action lawsuit against Longevity Lounge Inc.
